New internal proceedings for trademark examination

With the main purpose of maximizing the resources available and improve the trademark services provided, the Costa Rican Trademark Office has implemented a new internal proceeding for trademark examination.

 Instead of multiple revisions, the application will be examined by the office just one time, so the applicant will be advised of all requirements for amendment and all grounds for refusal. This means that the examination of an application by the examining attorney should be a complete examination. A complete examination includes a search for conflicting marks and an examination of the written application, the drawing and any specimen(s), to determine whether the mark is eligible for the type of registration requested, whether amendment is necessary, and whether all required fees have been paid.

The implementation of this procedure responds to the necessity of expedite prosecution of trademark applications, in accordance with the guiding principle of celerity of registration.
